Mar-a-Lago Case Dismissal Could Spell the End of Smith’s D.C. Prosecution and Anti-Trump Lawfare
After surviving an assassination attempt over the weekend, Trump began the week with good news in the form of Judge Aileen Cannon dismissing special counsel Jack Smith’s Mar-a-Lago case against him in a seismic ruling that could spell the end of his federal legal woes and build on his existing momentum in the national spotlight.
Smith had charged Trump in connection with his storage and retention of materials at his Mar-a-Lago estate, which the FBI raided in August of 2022. Attorney General Merrick Garland appointed Smith in late 2022 to pursue the case and he brought an initial indictment in 2023. Trump pleaded not guilty though Smith in July of that year brought a superseding indictment with additional charges. The former president has long maintained he was innocent of any wrongdoing and that the case was part of a broader political witch hunt designed to derail his 2024 bid for the White House.

I understand this is sensitive and it’s difficult, but these questions are briefed and they’re before the Court.” So said Judge Aileen Cannon to David Harbach, one of Special Counsel Jack Smith’s lead prosecutors in the government’s espionage and obstruction case against former president Donald Trump, during a hearing on Wednesday. While temperatures spiked outside the federal courthouse in Fort Pierce, Florida throughout the day, so too did the climate inside Cannon’s courtroom.

An exhibit filed today by Donald Trump in a motion to suppress evidence seized during the FBI’s August 2022 raid of Mar-a-Lago revealed shocking new details about the bureau’s plans to use deadly force and even engage the former president and his security detail that day if necessary. The document is just one of many court filings recently ordered unsealed by Judge Aileen Cannon, who is presiding over the matter in southern Florida.
In an August 3, 2022 operations order for “Plasmic Echo,” the FBI’s code name for the government’s investigation into Trump’s alleged mishandling of national defense material, FBI officials furnished instructions on to proceed with the unprecedented raid. “FBI [Washington Field Office] and FBI [Miami] agents and [Evidence Response Team] will effect a search of designated locations within Mar-a-Lago (MAL) to locate and seize classified information, NDI, and US Government records as described in captioned search warrant,” the document read.

Judge Bruce Reinhart, who on August 5 signed off on an unprecedented search warrant for the Mar-a-Lago home of former President Donald Trump, was appointed by a gaggle of left-wing judges.
Federal District Court Judges, in this case Judges in the United States District Court for the Southern District of Florida, appoint magistrate judges who handle tasks assigned to them by the District Court judges.
