Trump-Appointed Judge Halts Biden ATF Rule Changing Definition of ‘Firearms Dealer’

Gun Show

A Texas judge granted an injunction Tuesday against a new Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) rule that changes the definition of a “firearms dealer.”

The ATF rule broadens the definition of “engaged in business” to extend beyond merely a “gunsmith or pawnbroker.” Trump-appointed federal Judge Matthew Kacsmaryk ruled that the plaintiffs had met the legal standards to be granted an injunction until the lawsuit is resolved.

Supreme Court Tosses Doctors’ Challenge to Abortion Pill

Mifepristone boxes

The Supreme Court sided unanimously Thursday against several doctors and pro-life medical associations who brought a challenge to the abortion pill.

In FDA v. Alliance for Hippocratic Medicine, the Supreme Court held that the doctors do not have standing to challenge the U.S. Food and Drug Administration’s (FDA) decision to roll back safety regulations for the abortion pill. While recognizing the plaintiffs have “sincere legal, moral, ideological, and policy objections to elective abortion and to FDA’s relaxed regulation of mifepristone,” Justice Brett Kavanaugh wrote in the majority rulings that those kind of objections are not enough to show the doctors would be injured by the FDA’s actions, noting the federal courts are “the wrong forum” for addressing their concerns.

Vaccine Shot

The earliest recipients of newly authorized COVID-19 vaccines, including healthcare workers, wrote in tens of thousands of adverse events related to the heart, ears, reproductive system and other conditions not listed as checkboxes in a federal active monitoring smartphone app.

The Centers for Disease Control and Prevention in the past two months turned over 780,000 “free text” entries from V-safe, the agency’s vaccine-safety monitoring system, under a January order by U.S. District Judge Matthew Kacsmaryk in a Freedom of Information Act lawsuit by Freedom Coalition of Doctors for Choice.

Federal Appeals Court Allows Abortion Pill Approval to Stand, with Restrictions

A federal appeals court has allowed the U.S. Food and Drug Administration’s approval of the abortion pill to temporarily stand with some limitations.

The Biden administration appealed and filed an emergency motion with the Fifth Circuit shortly after Northern District of Texas Judge Matthew Kacsmaryk issued a preliminary injunction against the FDA’s approval of the drug on Friday, a decision the administration called “extraordinary and unprecedented.” In a 2-1 ruling issued late Wednesday night, the Fifth Circuit granted in part the motion for a stay pending appeal, narrowing the judge’s ruling to apply only to rules issued by the FDA prior to 2016.

Federal Judge Suspends FDA Approval of Abortion Pill

A federal judge on Friday suspended the Food and Drug Administration’s approval of mifepristone, effectively stopping sale of the drug nationwide.

Mifepristone is one of two drugs necessary for a sort of abortion cocktail that allows recipients to terminate a pregnancy via pill. The second drug, misoprostol, is available through a traditional prescription. The FDA in January announced a regulatory change to permit major pharmacy chains to carry the drug in stores as opposed to mail-order pharmacies or select clinics.
