Court Upholds Rule Barring Gender Identity on Kansas Drivers Licenses

A judge ruled Monday that barring Kansas drivers from identifying as transgender on their licenses did not violate their constitutional rights.

Republican Attorney General Kris Kobach filed a lawsuit against Democratic Gov. Laura Kelly in July 2023 after the governor’s office said that the state would continue to issue driver’s licenses reflecting a person’s gender identity despite the Kansas Legislature passing a bill requiring only biological sex on government IDs, according to the Kansas Reflector. Judge Teresa Watson upheld her previous ruling from last year barring the Kansas Department of Revenue from adding options other than a person’s biological sex to driver’s licenses and further stated that the law did not violate transgender individuals’ rights under the state constitution, according to court documents.

Commentary: Rapidly Declining Mainline Church Seeks to Require Ministers to Support Transgenderism, Gay Marriage

The Presbyterian Church (USA) has permitted, but not required, its ministers to perform same-sex marriage ceremonies since 2014. But that allowance is no longer sufficient for the progressive denomination; it now aims to mandate that future ministers affirm transgenderism and same-sex marriage as prerequisites for ordination. At its General Assembly this June, the denomination will take up legislation that would implement that requirement.

The Presbyterian Church (USA)’s proposed requirement stands out for its inclusion of affirmation for transgenderism alongside same-sex marriage. Specifically, it does so by adding “gender identity” and “sexual orientation” to its list of groups protected from discrimination, included in “worship, governance, and emerging life.” The proposal would also change the denomination’s “[s]tandards for ordained service” to make it obligatory for ministry candidates to pledge adherence to this principle of “non-discrimination.”

U.S. Census to Ask Questions on Gender Identity, Sexual Orientation for First Time

The United States Census is planning to introduce questions on gender identity and sexual orientation for the first time in its history, according to The Associated Press.

The questions will be sent to 480,000 households and can be answered online, by mail, via phone or during in-person interviews, with only half expected to respond, according to the AP. If approved, the bureau plans to include them in its annual American Community Survey and will ask respondents about their sex assigned at birth and their sexual orientation.

California Passes Bill Threatening Custody of Parents Who Won’t ‘Affirm’ Their Kids’ Gender

The California legislature passed a bill Friday that requires a judge to consider whether or not a parent “affirms” their child’s “gender identity” in a custody dispute.

Democratic Sen. In a letter obtained by The Star News Network, four members of the U.S. Commission on Civil Rights (USCCR) are calling upon House Speaker Kevin McCarthy (R-CA) to hold hearings on the Biden administration’s “radical and legally unsupported proposals to change Title IX” to require that its prohibition on sex discrimination be interpreted to bar discrimination on the basis of sexual orientation or gender identity.

The Sacred Heart of Jesus Parish (SHJP) Catholic school filed a lawsuit Thursday against Michigan state officials after the state’s civil rights laws were changed to include gender identity and sexual orientation as protected categories, which the school argued the change would force it to violate its religious beliefs.

In July, the Michigan Supreme Court ruled that Michigan’s Civil Rights Act must include sexual orientation and gender identity under its protections from discrimination. A poll published Thursday found 72.7 percent of American voters say they are not likely to vote for candidates running in the midterm elections who support gender transition procedures, such as puberty blockers, cross-sex hormones, and surgeries, for minors.

Commentary: Critical Race Theory Is Being Taught in Public Schools

The National School Boards Association (NSBA), which according to its website serves about 51 million public school students nationwide, made headlines recently when it requested that President Biden use federal terrorism statutes and issue other “extraordinary measures” against those pushing back against school boards that are indoctrinating children in critical race theory (CRT) and gender ideology. Much has already been written about this, and for good reason. In our Constitutional Republic, the federal government has no authority over education. As James Madison famously stated in Federalist 45, “The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite.” A quick scan of the Constitution reveals that the people and states have delegated no educational power to the federal government. Because all power originates in the people and the states, all powers not delegated to the federal government remain in the states and the people. The Tenth Amendment states this principle explicitly.

Instead of leaving educational policy (and challenges to it) to state and local governments, however, President Biden is using the power of federal law enforcement to quell debate and intimidate parents from exercising their First Amendment rights. Using federal law enforcement to chill debate on what is and should be a truly local issue is totalitarianism at its zenith. All totalitarian states centralize educational control in the federal government for the purpose of indoctrinating children in their preferred ideology.  The Nazis, Soviets, and Communist Chinese all did (or still do) it, and now, following in their footsteps, the Biden administration is giving it a try, albeit in an indirect, more nuanced manner.

But this piece is actually about a second, more subtle point. A key presupposition underlying the NSBA’s request — and the Biden DOJ’s response — is that parental protests against school boards are completely unfounded. As the NSBA letter notes, “many public school officials are [] facing physical threats because of propaganda purporting the false inclusion of critical race theory within classroom instruction and curricula.” The letter then states that “[t]his propaganda continues despite the fact that critical race theory is not taught in public schools and remains a complex law school and graduate school subject well beyond the scope of a K-12 class” (emphasis added).

The state of Texas filed a lawsuit on Monday against the Biden Administration, over a mandate enacted in June dictating that “transgender” individuals must be referred to by their preferred pronouns and be allowed to use restrooms of their choice, Fox News reports.

Texas Attorney General Ken Paxton, in a statement on the lawsuit against the Equal Employment Opportunity Commission (EEOC), said that “states should be able to choose protection of privacy for their employers over subjective views of gender.” Paxton declared that “this illegal guidance puts many women and children at risk. If the Biden administration thinks they can force states to comply with their political agenda, my office will fight against their radical attempt at social change.”

State Attorneys General Split on Reinstating Obama’s Race-Based School Discipline Guidance

Attorneys general in more than half the states are starkly divided on how to view alleged racial disparities in school discipline, filing competing briefs in a Department of Education proceeding that drew nearly 2,700 comments.

Arizona led a coalition of 15 states to oppose the reinstatement of the Obama administration’s “disparate impact” guidance, which said statistical differences between the races in school discipline could serve as the basis for a federal civil rights investigation.

Federal health officials announced a final rule Friday scrapping an Obama-era regulation that forced medical workers to perform abortions despite their religious beliefs.

The Obama administration’s 2016 regulation, already vacated by a court ruling, also redefined sex-based discrimination in health care to include questions of gender identity.
