Gender Identity Proponents Block Biological Sex Challenges

Proponents of the importance of biological sex to sports, science and law want to explain to critics and undecideds why gender identity is not a substitute. Some of their critics are working to ensure they can’t get a hearing.

It’s not just former NCAA swimmer Riley Gaines, now in a spat with Pennsylvania State University over whether she was ever approved to speak on campus for “Real Women’s Day” on Oct. 10, a date chosen for its Roman numerals that mirror women’s XX chromosomes.

Civil Rights Commissioners Urge Speaker Kevin McCarthy to Hold Hearings on Title IX to Assure ‘Biological Sex’ is Protected

In a letter obtained by The Star News Network, four members of the U.S. Commission on Civil Rights (USCCR) are calling upon House Speaker Kevin McCarthy (R-CA) to hold hearings on the Biden administration’s “radical and legally unsupported proposals to change Title IX” to require that its prohibition on sex discrimination be interpreted to bar discrimination on the basis of sexual orientation or gender identity.

The letter, signed by USCCR Commissioners labor attorney Peter Kirsanow, University of San Diego law professor Gail Heriot, Public Interest Legal Foundation President J. Christian Adams, and South Carolina African American Chamber of Commerce CEO Stephen Gilchrist, asserts to McCarthy that the Biden Education Department’s Office for Civil Rights (OCR) has erred in its claim that the Supreme Court’s decision in Bostock v. Clayton County “requires that Title IX’s prohibition on sex discrimination be interpreted to prohibit discrimination on the basis of sexual orientation or gender identity.”

St. Mary’s College Says Biological Sex Messaging Does ‘Not Align’ with Its Mission

Saint Mary’s College in Notre Dame, Indiana, denied the foundation of a Turning Point USA chapter, according to an email from the dean of students, because Turning Point USA’s messaging on biological sex does “not align” with the Catholic college’s mission.

Claire Bettag, a sophomore student from Chicago, pushed back against Saint Mary’s denial of the club over the course of several months, according to emails reviewed by The Daily Signal. But the college’s dean of students, Gloria Jenkins, ultimately told Bettag that Turning Point USA’s messaging on transgender issues does not align with Saint Mary’s mission.

Commentary: Soros Mindset Invades Nashville

Sarah Beth Myers and George Soros

Obviously, a multitude of factors are at play, but if you had to pick one man most responsible for the massive increase in crime of all sorts in American cities over the past few years, from pervasive looting to assault (sexual or otherwise) to murder, it would be billionaire investor George Soros.

Through his Open Society Foundations—described as “the world’s largest private funder of independent groups working for justice, democratic governance, and human rights”—plus various other entities, sub-entities, and cutouts, Soros has financed the political campaigns of numerous district attorneys and attorneys general across the country.

All of them were leftists, working from a principle of minimal, if any, incarceration or bail in any but the most extreme situations—and often in what most of would assume was extreme. The perpetrator, most probably, they assume, is the product of a miserable childhood, and therefore worthy of more sympathy than the victim. That many who had equally miserable childhoods still are able to function as law-abiding adults is evidently of little consequence to these DAs and AGs.

Commentary: We Can’t Split the Difference on Culture

The United States is an outlier among established democracies in two respects: We face both falling social trust and rising polarization. I have argued that the two dynamics connect in a doom loop. Trust in others and institutions falls, leading to greater polarization, which drives trust down even more. That is why the two processes are getting worse at the same time. A nasty dynamic has taken hold in the country, and it regularly affects all of us.

Many issues polarize us, but we should prefer polarization on economics to polarization on culture. Polarization is least damaging on issues most amenable to “splitting the difference”—as many economic issues are.

Consider taxes. Progressives want higher taxes on the rich, while conservatives want lower taxes. The possibility of compromise always exists—and even if it is obscured beneath the surface of our political tempers, uncovering it is not hard. For example, we could average our preferred tax rates, and no one would come away emptyhanded. Granted, that’s not how we have handled this issue in the past, but it’s at least conceivable.

Biologically Male Middle School Student Can Run on Girls’ Cross Country Team, Judge Rules

Man running on a gravel road during the day with a blue shirt on

A biologically male middle school student may run on a girl’s cross country team this fall in spite of West Virginia’s new law banning biological males from women’s sports, U.S. Circuit Judge Joseph R. Goodwin ruled Wednesday.

Lawyers from the ACLU-West Virginia had argued that HB 3293 would unfairly prevent the 11-year-old student, Becky Pepper-Jackson, from participating on a girls cross country team.

Goodwin issued a preliminary injunction Wednesday allowing Pepper-Jackson to “sign up for and participate in school athletics in the same way as her girl classmates.”

Biden Administration Won’t Define ‘Sex’ as Biological as Title IX Review Starts

Women's soccer game

The Biden administration has rejected a petition to define sex in biological terms as it reviews the Trump administration’s Title IX policies on women’s sports and sexual misconduct proceedings.

The rejection came a day after the Department of Education announced it was soliciting public input on implementing President Biden’s March 8 executive order on sex discrimination.

The Women’s Liberation Front (WoLF), a self-described radical feminist group that opposes transgender policies, said it was pleased that the department did not reject its legal arguments out of hand.
